Evans and Peek provide a full spectrum of Family Law services to our clients in Central Texas. James W. Evans has practiced law for more than 15 years and has dedicated his practice of law to serving families of Central Texas. His focus practice areas include divorce, alimony, child support, adoption and custody disputes, and wills and estate planning.

Mr. Evans is a member of the Family Section of the Travis County Bar and the State Bar of Texas. After graduating from law school Mr. Evans was a former assistant district attorney in the Dallas-Ft. Worth are. He now lives in Austin where he lives with his wife and their two children.

Representative Outcomes- Attorneys at the firm represent clients in a variety of complex family matters and civil transactions. The following is a general description of the type of cases that we have represented for our clients:

Adoption- Secured adoption of a child for a non-biological parent over the objection of the biological parent.

‘Agreed’ Divorce- Provided a value priced drafting service to a family who had been separated for several years, where ready to “move on,” and wanted the peace of mind, safety and security that their family and assets were protected after the divorce.

Mediated Divorce- Settled a $6 million dollar community estate, without going to court once and using a professional mediator to resolve the final property and child custody support case. Combined aggressive research on valuations, exacting discovery and diplomacy to attend to the interest of the client to avoid court dispute and high tensions, to retain dignity.

Collaborative Divorce- Represented a professional and his wife in a Collaborative Divorce, where the parties were able to privately settle their disputes outside of court and with the help of third party professionals including a psychologist and business evaluator to determine the value of a closely held family business and CPA to assist with taxes.

Psychological Expert Testimony- Presented two rebuttal expert witnesses in a child custody case to invalidate a tenured psychology professor in a custody case. Presented expert testimony involving forensic psychological tests including the Rorschach and MMPI examinations.

Business Valuation- Represented a client in a civil case where family members were at odds over the break up of a family business. At the same time, one of the family members was contesting the sale of the business due to her pending divorce. Worked with the varied legal teams, both corporate and family to untangle the property claim related to the divorce allowing the sale of the business to go forward.

Termination of Parental Rights- Terminated the parental rights of a father who was convicted of a felony and had abandoned the minor children. Secured this outcome on behalf of the grandparents and over the objection of the biological mother.

Grandparent Rights

Child Support Modification- Secured a greater than guideline child support modification for a client resulting in $2,500 in monthly support for the managing conservator spouse.

Custody Modification- Was awarded a reversal of custody where a mother who had a previous history of mild addiction, had rehabilitee herself, securing employment and stable employment. The children where returned to their mother and she was awarded child support.

Step Parent’s Rights- Secured a possession schedule and custodial rights for a non-biological step-father, who had divorced the mother of the child, but the court found that it was in the best of the children to continue visitation with the children following the dissolution of the marriage.

International Custody Modification- Represented a military spouse, whose husband had withheld the transfer of the minor children from an overseas military base to the United States. Worked with military officials and the Texas District Courts to secure the children and their supervision for the mother.

Electronic Discovery and Technology– Used forensic computer experts to discover a secret Internet business of a client’s spouse. Secured additional awards in the community property award for the client based upon a scan of computer hard drives, cell phones and review of computer source code.

Reconciliation- Following the interview and initial legal activities of a pending divorce, provided legal counsel to assist the client to reduce risks related to the reasons for the initial divorce pleading and to allow family counselors and clergy to assist the family to reconcile as man and wife.
